Trademark and Copyright Infringement

In the interest of respecting intellectual property, Zello does not allow content that violates copyright or trademark laws. 

This article will provide examples of what that content might look like as well as the steps you should take if you believe your intellectual property rights have been violated.

Possible Violations

Below are examples of content that could violate Zello's trademark and copyright infringement policies:

  • Using someone else's trademarked or copyrighted material in a channel name, username, channel profile, or user profile in an attempt to mislead or confuse others;
  • Using trademarked or copyrighted material in an attempt to impersonate another organization or person.

Permitted Content

Below are examples of content that typically would not violate Zello's trademark and copyright infringement policies:

  • Use of trademarked or copyrighted material as a reference or in a way that clearly does not intend to impersonate the owner;
  • Including a clear disclaimer in a channel or user profile description that the channel or profile is not affiliated with the trademarked or copyrighted material;
  • Copyrighted or trademarked material that has been approved or given proper attribution.

Reporting Possible Infringement

If you believe a channel or user is using your trademark or copyright in a way that is deceptive or intends to impersonate your brand, please submit a ticket for our review by emailing support@zello.com. Please include the following information:

  • An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
  • A description of the copyrighted work or other intellectual property that you claim has been infringed;
  • A description of where the material that you claim is infringing is located on our service, with enough detail that we may find it on our service;
  • Your address, telephone number, and email address;
  • A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law; and
  • A statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner’s behalf.

Resolving Disputes

If Zello determines there has been a valid complaint of trademark or copyright infringement:

  • Zello staff will contact the channel or user and inform them via email that a trademark or copyright holder has submitted a complaint against them;
  • The user will be given an opportunity to remove the infringing content within five business days;
  • Zello staff will provide your contact information to the involved user if they wish to mediate a solution with you;
  • After five business days, if the involved user has not responded or refuses to remove the infringing content, Zello staff will take action to remove the channel or account;
  • Both parties involved in a dispute will be kept informed of the report's status;
  • Upon resolution, the ticket will be closed.
